DEFINITIONS

• Agreement refers to the agreement between HostGrower Limited and the Customer for HostGrower Limited to provide services to the Customer.
• Bandwidth refers to the data transmission rate in bits per second using HostGrower Limited equipment.
• Confidential Information means information that either party has identified as confidential or proprietary, or whose nature is clearly confidential or proprietary.
• Customer refers to you, an individual or entity who has agreed to these Terms of Service.
• Fees shall refer to the fees for the services, as displayed on hostgrower.com.
• Intellectual Property Rights shall mean any and all patents, trademarks, service marks, copyrights, know-how, design rights, or other intellectual or similar rights, whether or not registrable in any country, as well as all or any goodwill relating to the same.
• Services refers to hosting.
• HostGrower Limited refers to HostGrower Limited, a company registered in England and Wales with company number 14636097. HostGrower Limited is the trading name of HostGrower Limited.
• You, Your & their grammatical variants refer to you, any other entity that owns or has a beneficial interest in you, or any other entity in which you own or have a beneficial interest.

1. SERVER USE

1.1 HostGrower Limited does not permit the storage of any of the following content on its servers:

• Illegal material, including copyrighted works, commercial audio, video, or music files, and any material in violation of any UK legislation.
• Pornography, erotic images, and other lewd or obscene content. The determination of “adult material” is at HostGrower Limited’s sole discretion.
• Use of pirated software, ROMs, emulators, hacking tools, password cracking, IP spoofing, or encryption for any of the above.
• Websites offering “links to” or “how-to” information about such materials.

2. UNRESTRICTED BANDWIDTH POLICY

2.1 High Bandwidth Usage:

• HostGrower Limited provides unrestricted use by maintaining very high bandwidth-to-customer ratios.
• If a customer is found abusing server resources, affecting other customers, HostGrower Limited reserves the right to implement the High Resource User Policy.

3. HIGH RESOURCE USER POLICY

3.1 Resources refer to bandwidth, processor usage, or disk space.
3.2 If a website monopolises available resources, HostGrower Limited may suspend the server to prevent misuse.
3.3 This policy is enforced only in extreme cases.

4. FEES & PAYMENT TERMS

4.1 All service fees are due in advance and non-refundable.
4.2 All fees are in GBP (£) and exclude VAT (Value Added Tax) unless otherwise stated.
4.3 HostGrower Limited reserves the right to change service prices at any time, with one month’s notice via email.
4.4 Additional hosted domains will be cancelled if the primary hosting package fees are not paid.
4.5 Customers must maintain a valid credit/debit card and email address on their account.
4.6 Accounts with fraudulent information or chargebacks may be suspended/cancelled.

5. VALUE ADDED TAX (VAT)

• All prices displayed on our website exclude VAT at 20%, in accordance with UK regulations. VAT will be applied automatically at checkout if applicable.

• Customers outside the UK may be eligible for VAT exemption or reclaim, requiring supporting documentation.

6. TERM & TERMINATION

6.1 The term for annually billed services is annual; for biennially billed services, biennial.
6.2 HostGrower Limited has an auto-renewal policy to ensure uninterrupted service.
6.3 If You do not want to renew a product, disable auto-renewal before the renewal date in your Account Control Panel.
6.4 HostGrower Limited reserves the right to terminate accounts in breach of these Terms.
6.5 Refunds are only issued on a pro-rata basis unless a violation has occurred.

7. CANCELLATION

7.1 Customers cannot cancel services mid-term but may disable auto-renewal.
7.2 If there are outstanding payments, cancellation will not be processed.

8. DISCLAIMERS & WARRANTIES

8.1 HostGrower Limited does not back up Your data. Loss of data caused by corruption, failures, or customer errors is not covered.
8.2 All services are provided “as is” without warranties.
8.3 HostGrower Limited is not liable for third-party services or indirect losses.

9. FORCE MAJEURE

Neither party shall be liable for breaches arising due to acts of God, government actions, war, riots, network failures, or third-party service interruptions.

10. GOVERNING LAW & DISPUTES

10.1 This Agreement is governed by English law and subject to the exclusive jurisdiction of English and Welsh courts.

11. EMAIL USAGE POLICY

11.1 You may not use HostGrower Limited email services to send spam, fraudulent, or offensive messages.
11.2 SMTP traffic may be blocked if bulk unsolicited emails are detected.

12. REPORTING ABUSE & MISUSE

If you need to report abuse, include time, date, and relevant logs to assist investigations. HostGrower Limited will cooperate with law enforcement.

13. MONEY-BACK GUARANTEE

13.1 You may cancel within 30 days of acceptance for a full refund (7 days for Middle Eastern users due to refund abuse).
13.2 Refunds are issued to the original payment method.
13.3 £10 service charge applies for time used.
13.4 Domain registrations/renewals are non-refundable.

14. DOMAIN NAME REGISTRATIONS

14.1 By registering a .uk domain, you agree to Nominet’s Terms & Conditions.
14.2 By registering other domains, you agree to OpenSRS policies and ICANN regulations.
14.3 Domains must be registered through or fully managed by HostGrower Limited to use its DNS services.

15. FREE DOMAIN FOR LIFETIME OFFER

• Available only for annual WordPress hosting Ultra packages.
• Covers .com, .net, .info, .org, and .uk domains.
• Premium domains are excluded.

16. DISCLAIMER OF LIABILITY

16.1 HostGrower Limited does not guarantee accuracy, completeness, or fitness for a particular purpose.
16.2 HostGrower Limited is not responsible for third-party websites linked from its pages.
16.3 HostGrower Limited will not be liable for indirect or consequential losses.

17. AMENDMENTS & NOTICES

17.1 You may not modify this Agreement unless signed by both parties.
17.2 Notices are considered delivered immediately via email or within 24 hours for overnight mail.

18. FINAL AGREEMENT

18.1 This Agreement represents the entire understanding between you and HostGrower Limited.
18.2 Any modifications or representations outside of this Agreement are not legally binding.
